Article 1: object
The purpose of these “general conditions of use” is to provide a legal framework for the terms of provision of Kinky Club (the “Site”) and their use by the “User”.
The general conditions of use must be accepted by any User wishing to access the Site. They constitute the contract between the site and the User. Access to the site by the User signifies acceptance of these general conditions of use.
Kinky Club reserves the right to unilaterally modify the content of these general conditions of use at any time.
The Site offers an online entertainment service that contains depictions and descriptions of explicit sexual activity.
ARTICLE 2: Legal notices
The host of the Kinky Club is the company OVH in the Lille Métropole commercial register 424 761 419 00045. The site's publication director is Mr. Alexandre Heyman.
You acknowledge that you are aware of the nature of the content provided by this Site, that you are not offended by this type of content and that you are accessing the Site of your own free will.
You prove that you are at least 18 years old, and that you have the legal capacity to enter into an agreement. If you are not 18 years old, you must exit the Site immediately and not use or access the Site or print or download any content from it.
You understand that all models appearing on the Site were, at the time these images were recorded, at least 18 years of age, and that the Site does not contain any child pornography.
We maintain a strong stance against child pornography and only publish images of consenting adults for consenting adults.
ARTICLE 3: Definitions
The purpose of this clause is to define the various essential terms of the contract:
Site: this term corresponds to the site at the following URL: www.kinkyclub.fr
User: this term designates any person who uses the Site or one of the services offered by the site.
User content: this is the data transmitted by the User within the Site.
Member: the User becomes a member when he is identified on the Site.
Username and password: this is all the information necessary to identify a User on the Site. The username and password allow the User to access services reserved for members of the Site. The password is confidential.
ARTICLE 4: Access to services
The Site allows the User free access to the following services:
- Watching video clips online
- Viewing photos online
- Online viewing of videos, after taking out a subscription or purchasing individually.
The Site is accessible free of charge anywhere and to any User with Internet access. All costs incurred by the User to access the service (computer hardware, software, Internet connection, etc.) are their responsibility.
The non-member User does not have access to services reserved for members. To do this, he must identify himself using his username and password.
The Site implements all means at its disposal to ensure quality access to its services. The obligation being of means, the Site does not undertake to achieve this result.
Any event due to force majeure resulting in a network or server malfunction does not engage the responsibility of Kinky Club.
Access to the Site's services may at any time be subject to interruption, suspension, modification without notice for maintenance or any other case. The User undertakes not to claim any compensation following the interruption, suspension or modification of this contract.

ARTICLE 5: Intellectual property
The brands, logos, signs and any other content of the Site are subject to protection by the Intellectual Property Code and more particularly by copyright.
The User must request prior authorization from the site for any reproduction, publication, copy of the various contents.
The User undertakes to use the contents of the Site in a strictly private context. Use of the contents for commercial purposes is strictly prohibited.
ARTICLE 6: Personal data
The information requested when registering on the Site is necessary and mandatory for the creation of the User's account. In particular, the email address may be used by the Site for the administration, management and operation of the service.
In accordance with the General Data Protection Regulation:
- the Site ensures that the User collects and processes personal information while respecting privacy,
- the User has the right to access, rectify, delete and oppose their personal data when they have created an account. The User exercises this right via simple request to the email address support@kinkyclub.fr.
ARTICLE 7: Liability and force majeure
The sources of information published on the Site are deemed reliable. However, the Site reserves the right to disclaim the reliability of the sources. The information given on the Site is for purely informative purposes. Thus, the User alone assumes full responsibility for the use of the information and content of this site.
The User ensures to keep his password secret. Any disclosure of the password, whatever its form, is prohibited.
The User assumes the risks associated with the use of his username and password. The Site declines all responsibility.
Any use of the service by the User directly or indirectly resulting in damage must be compensated for by the Site.
An optimal guarantee of the security and confidentiality of the data transmitted is not ensured by the Site. However, the site undertakes to implement all necessary means to best guarantee the security and confidentiality of data.
The Site cannot be held liable in the event of force majeure or the unforeseeable and insurmountable act of a third party.
ARTICLE 8: Hypertext links
Numerous outgoing hypertext links are present on the Site, however the web pages to which these links lead in no way engage the responsibility of Kinky Club which does not have control of these links.
The User therefore undertakes not to hold the Site responsible for the content and resources relating to these outgoing hypertext links.
ARTICLE 9: Evolution of the contract
The site reserves the right at any time to modify the clauses stipulated in this contract.
ARTICLE 10: Duration
The duration of this contract is indefinite. The contract produces its effects with regard to the User from the use of the service.
ARTICLE 11: Applicable law and competent jurisdiction
French legislation applies to this contract.
